Long Title: | AN ACT TO AMEND TITLE 29 AND TITLE 16 OF THE DELAWARE CODY BY ESTABLISHING AN ELECTRONIC WEB-BASED BACKGROUND CHECK CENTER FOR EMPLOYMENT IN LONG TERM CARE OR COMMUNITY SETTINGS. |
Synopsis: | The new statute, 29 Del.C. § 7971A-F, establishes an electronic system for integrating data which will permit a prospective employer to determine the suitability of a job applicant. The statute applies to those seeking work in a long term care setting, or in community settings. Use of the electronic system is mandatory. DHSS is authorized to establish a user fee. Limited liability is provided.
Existing statutes which establish criminal background checks and mandatory drug screening as a requirement for employment in long term care settings, community settings and the Delaware Psychiatric Center are amended to be compatible with the requirements of the electronic system. Implementation of a comprehensive system requires fingerprinting of some current employees for purposes of updating their criminal record.
